1. Terms and Conditions Agreement.
Before conducting business with The Property Investor Group Ltd and using this website you should read, and understand fully the following Terms and Conditions. By using the Products, Services and Website you are confirming your agreement, without limitation or qualification, to comply, and be bound, to our Terms and Conditions.
2. Fees
Unless otherwise stated a finders fee (normally 2%-3% + vat) is payable to The Property Investor Group Ltd at the point of reservation. This fee will be based on the gross market price. Any reservation fee required by the developer or his agent is in addition to this fee and is non-refundable if you decide not to continue with the purchase. For the purposes of our agreement, we shall be deemed to have introduced a property or property related service to you, if you have either received the particulars of a property from ourselves directly or indirectly, or through agents or individuals whom you have instructed us to negotiate with on your behalf. The fees are due within two calendar weeks of reservation with the Developer.
3. Cancellation.
The initial reservation fees, whether payable to The Property Investor Group Ltd or the developer are non-refundable. You should ensure that you are entirely satisfied with your purchase before completing a reservation form, at that point you are deemed to have engaged our services and as such we will start incurring costs on your behalf. In the event of breach of our Terms and Conditions, The Property Investor Group reserves the right to cancel your reservation in writing, without refunding your reservation costs.
4. Services.
We reserve the right to withdraw or amend the service we provide on our Website without notice. We also reserve the right to withdraw you as a member of The Property Investor Group site in the event you do not comply with these Terms and Conditions.
We will not be liable if for any reason our Website is unavailable at any time or for any period. The supply of the services by us is subject to the terms and conditions set out in this agreement, and unless otherwise expressly agreed in writing by us, these conditions shall prevail over any other terms and conditions and shall comprise the whole agreement between you and us. If at any time any of these conditions are found to be unreasonable, invalid or unlawful then the validity of the remaining conditions or parts thereof shall not in any way be affected or impaired and shall be in force as if the unreasonable, invalid or unlawful part had not been included.
Once registered you are under no obligation to purchase a property through The Property Investor Group Ltd, however by registering you give authorisation to be contacted by The Property Investor Group Ltd when opportunities arise.
The discounts and benefits you receive have been arranged for you by The Property Investor Group Ltd; under no circumstances should these be discussed with the developer or any of its agents. If a property that has been initially offered to the client by The Property Investor Group and is subsequently purchased directly through the developer or agents the finders fee will be due to The Property Investor Group. Properties will be sold on a strictly first come first served basis. You will therefore be deemed to have first option on any property following completion of the reservation form and any relevant fee.
5. Property Information.
Whilst every effort is made to ensure the information displayed on the website is accurate and complete, The Property Investor Group Ltd makes no representation and gives no warranty as to the accuracy of the information supplied. The Property Investor Group Ltd accepts no liability for any errors, misprints or omission herein (whether negligent or otherwise).
All information, floor plans, photographs etc are for guidance only; they only give a general indication of the properties sizes, specifications and plans and are subject to change. Every effort has been made to give accurate concepts and calculations, they are for guidance and not a statement of fact, all liability is disclaimed.
The Property Investor Group Ltd do not personally test appliances, services or equipment within newly built properties, it is recommended the purchaser carries out their checks by self inspection.
It is advised that all prospective purchasers independently check and verify information provided and take the appropriate legal and other advice from solicitors and other specialists.
It should be particularly noted that in the case of off-plan developments they run the additional risk of changes in specification and general layout prior to build completion.
6. Client Information.
All correspondence between The Property Investor Group Ltd and the client is private and confidential and should not be discussed with any unrelated third party. We only use information taken to automatically generate the online forms and to ensure you get the best possible service regarding your requirements.
As part of the property sale process we will require you to inform us of the progress of your purchase. Failure to provide this information may result in a cancellation of your reservation and loss of any initial fees.
7. Investment advice.
The Property Investor Group Ltd does not and is not authorised to give investment advice. You should not consider any information on this website, or information given verbally as investment advice. You should consult and engage the services of a professional adviser.
8. Intellectual Property.
The Intellectual property within the Website is the ownership of The Property Investor Group Ltd. This is protected by international copyright law and treaties. You must not without permission alter any material you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you nor may you create a link to any part of our Website other than the home page. We reserve the right to withdraw linking permission without notice.
9. Disclaimer.
The Property Investor Group Ltd shall not be liable for any loss or damage whatsoever arising as a result of any person acting or refraining from acting in reliance on any information contained therein. No investor should rely solely on the information contained in this website as it does not purport to be comprehensive or to render specific advice. For the avoidance of doubt, nothing in this Agreement shall confer on any third party any benefit of the right to enforce any term of this Agreement except as otherwise stated. This Agreement is governed by the laws of the country of England and Wales and any dispute or action arising out of this site shall be determined in accordance with such laws.
